Florida’s Minimum Wage Rises
Florida’s minimum wage rises to $8.46 per hour beginning January 1, 2019.
The minimum wage per hour for tipped employees rises to $5.44.
The previous minimum wage in Florida was $8.25 and $5.23 for tipped employees.
Employees who don’t receive at least the new minimum wage after notifying their employer and giving the employer 15 days to resolve any claims for unpaid wages may bring a civil action against the employer to recover back wages plus an equal amount for liquidated damages and reasonable attorney’s fees. Should your employer take adverse action against you for requesting the increased minimum wage, you could bring an action for illegal retaliation. Adverse action could be in the form of a demotion, reduction in scheduled hours, or even termination.
